A former elementary school teacher in Burlington and Hamilton has been handed a prison sentence of more than five years for sexually assaulting seven male students in the 1980s. Barbara Baxter, aged 88, was convicted on seven charges of sexual assault and acts of gross indecency after a jury trial in February.

The sentencing was delivered by Justice Kendra Coats at an Ontario Superior Court of Justice session in Milton on January 13. The incidents came to light when a man reported to Halton police in June 2022 that he was sexually abused at Pineland Public School in Burlington during the early 1980s when he was in Grade 8. Additional reports emerged in February 2023, with three more men disclosing incidents between 1983 and 1987 at the school and at Baxter’s residence in Burlington.

The former students’ identities are shielded by a publication ban. During the sentencing hearing, the court heard emotional victim impact statements, revealing the deep scars left by the abuse. One victim shared his struggles with feeling unsafe and resorting to drugs at a young age to cope, feeling silenced by those in authority. Another victim described enduring decades of emotional turmoil, affecting his health and mental well-being, robbing him of his peace and innocence.

One victim labeled the impact of Baxter’s actions as “mental torture,” detailing enduring PTSD, anxiety, and depression for over 40 years, leading to financial instability and strained relationships. The Crown emphasized the severe harm caused by the abuse, stressing the breach of trust by a teacher in a position of authority over vulnerable children.

Defense arguments highlighted Baxter’s health issues, lack of criminal history, and family support as factors to consider in sentencing. The court also heard about the significant collateral consequences of Baxter’s potential incarceration due to her health conditions and personal circumstances. The Crown underscored the need for denunciation and deterrence in sentencing to address the lasting effects of such offenses.

Before her tenure at the Halton District School Board, Baxter served at the Hamilton-Wentworth District School Board from 1961 to 1968. Support resources are available for sexual assault survivors and individuals struggling with mental health challenges through crisis lines and local services.
