In recent years, both the central and state governments have been actively promoting industrial growth with the aim of boosting business, creating more job opportunities, and strengthening the economy.

To facilitate this growth, there have been efforts to simplify procedures, streamline approvals, and ease regulations. A notable change has been the gradual elimination of the previously prevalent “Inspector Raj” system.

Instead, a new system based on trust has emerged, emphasizing self-certification, minimal inspections, and the expectation that employers will voluntarily comply with the law.

While this approach may seem modern, efficient, and fair, there is a significant challenge: it assumes a level of compliance culture that may not currently exist.

Having served in the Employees’ State Insurance Corporation for nearly two decades, I observed a pattern of intentional non-compliance rather than accidental errors among employers. They engaged in tactics such as underreporting workers, maintaining dual records, and structuring their operations to circumvent labor laws effectively.

One illustrative case involved an inspection of a newspaper establishment where interconnected companies operated within the same premises but maintained legal separation. This scenario revealed how corporate structures could obscure accountability and compliance with labor regulations.

Even after my retirement, I continue to observe instances of non-compliance with social security benefits and minimum wage regulations, especially among smaller entities and outsourced employees of large corporations.

The current trend towards reducing inspections significantly requires a reality check, as it may inadvertently reward non-compliance rather than improving adherence to labor laws. Balancing trust with effective enforcement mechanisms is crucial to ensure that workers receive essential protections and rights.

Labor laws are designed to safeguard workers’ interests, including health coverage, fair wages, and reasonable working conditions. Diligent enforcement is essential to prevent these protections from being eroded or disregarded.

While trust is valuable, a cautious approach that combines smart, data-driven inspections with transparency and accountability is necessary to uphold labor standards effectively. Striking this balance is vital to prevent exploitation and ensure a fair and safe working environment for all employees.
