In a courtroom where her husband, parents, and lover awaited, a 19-year-old woman made a life-changing decision. Declaring her independence, she expressed her desire not to remain with her husband or parents. The Madhya Pradesh High Court’s Gwalior bench endorsed her choice.

The situation originated from a habeas corpus plea filed by her husband, Avdhesh, nearly a year post their marriage. Alleging that his wife was unlawfully held by another man, Anuj Kumar, he sought legal intervention. Acting on court orders, police located the woman and temporarily housed her at a one-stop center before presenting her in court.

During the proceedings, the woman’s family, husband, and partner were all in attendance. When asked about her preference, she candidly discussed her marriage, highlighting a significant 21-year age gap – she was 19, while her husband was 40. She conveyed dissatisfaction with her married life, citing alleged mistreatment and imbalance in the relationship. Firm in her decision, she expressed her wish to reside with her partner, Anuj Kumar.

Despite court-mandated counseling aimed at reconsideration, the woman remained resolute in her choice. Her partner assured the court of his commitment to her well-being. Justices Anand Pathak and Pushpendra Yadav of the division bench upheld her autonomy, emphasizing her right as an adult to determine her living arrangements.

To ensure her safety and welfare, the court ordered a six-month monitoring period where designated officials, known as “Shaurya Didi,” would oversee her well-being. Following necessary formalities, she was to be released from the one-stop center.

This verdict aligns with a recent ruling by the Allahabad High Court, emphasizing that no offense occurs when a married man engages in a live-in relationship with an adult woman with mutual consent. The judiciary stressed the separation of morality and law, asserting that societal views should not influence the protection of individuals’ rights.

What began as a custody dispute culminated in a strong affirmation of personal agency. By permitting the woman to depart with her partner, the court underscored the principle that adults have the right to make life decisions free from familial, marital, or societal pressures.
