A judge in the United States ruled on Friday to dismiss Elon Musk’s fraud allegations against OpenAI and co-founder Sam Altman. However, the lawsuit will proceed to trial regarding Musk’s claims of breaching charitable trust and unjust enrichment. The decision was made by U.S. District Judge Yvonne Gonzalez Rogers in Oakland, California.

Jury selection is set to commence on Monday, with opening statements anticipated on Tuesday. Musk had advocated for the dismissal of his fraud and constructive fraud accusations to streamline the case and maintain the focus on ensuring OpenAI’s mission of benefiting humanity rather than solely generating wealth.

The legal dispute revolves around Musk’s assertion that OpenAI, along with Altman and Microsoft, misled him and the public by establishing a for-profit entity in 2019 following his departure from OpenAI’s board. Reports suggest that OpenAI is gearing up for a potential IPO that could value the company at $1 trillion.

Musk is pursuing $150 billion in damages, as per sources close to the case, with the intention of channeling the proceeds to OpenAI’s charitable endeavors.
