A sexual harassment scandal at a Tata Consultancy Services (TCS) BPO unit in Nashik, Maharashtra, has brought attention to the efficacy of corporate grievance mechanisms. Despite complaints over several years, there were allegations of delayed action. Eight female employees reported incidents of sexual harassment, rape, attempts at religious conversion, coercion, and humiliation between 2022 and early 2026. The company’s HR department and POSH officials were accused of inaction. A Special Investigation Team (SIT) is now investigating the case, leading to seven arrests, including individuals like Asif Ansari and Danish Shaikh. TCS has suspended the employees involved and is cooperating with authorities. Chairman N Chandrasekaran expressed deep concern over the allegations and assured a thorough investigation to identify those responsible.

TCS’s FY25 annual report outlines a formal grievance redressal framework with multiple reporting channels for employees, customers, and stakeholders to report violations such as harassment and human rights concerns. The company is committed to reviewing and acting upon substantiated complaints, handling concerns confidentially, and not tolerating retaliation against complainants. The company’s policy is guided by a code of conduct and zero-tolerance for rights violations.

Under the POSH Act, complaints of sexual harassment must be formally recorded and examined by an Internal Committee within 90 days, ensuring both parties are heard, confidentiality is maintained, and protection against retaliation is provided. The law mandates that complaints should not be handled informally and must go through a structured process overseen by an independent committee.

The FIRs in the Nashik case detail repeated allegations of misconduct, including inappropriate touching, sexual remarks, and attempts to force unwanted conversations. The rise in reported sexual harassment cases at TCS over the past years has raised concerns, with the company attributing it to increased awareness. TCS reported 125 complaints in FY25, with 78 upheld and 23 pending at year-end. The case highlights the importance of effective implementation of policies and escalation of complaints to the formal grievance process.

When internal mechanisms fail, victims can approach the Local Complaints Committee, file police complaints for criminal offenses, seek intervention from district authorities, or challenge employer inaction through legal means. In the Nashik case, complaints escalated to police action and arrests due to alleged failures in the internal grievance process. TCS has initiated an internal probe to investigate how complaints were handled within the organization. The company has pledged to take strict action against those found guilty and implement necessary process improvements.
